A Theory that Cannot Be Ignored
Hans Kelsen's legal theory is not widely taught in the Analytic tradition, however this is an oversight. Kelsen presents a prescriptivist legal theory that provides a justification for a strong sense of normativity. In fact, the normativity appears to be applicable to all "social orders" or system of norms, legal, moral and otherwise. While I won't go into an exegesis of the theory here, I shall say that he discusses the famous theory of the "Basic Norm" which provides people with epistemic justification of obligations. This aspect of the theory is what sets it apart from any other legal theory I have encountered, especially among the legal positivists.I heavily suggest this book to any jurist or legal theorist. It provides insight into how people can approach the law and make sense of the operations of the legal system.

This book can be hard going but if you grasp the theories and understand how they are linked with jurisprudence than you will enjoy the book.

A classic book. A must-read to every law student anywhere in the world. The Pure Theory of Law goes beyond time and is still relevant nowadays. "The theory attempts to answer the question of what and how the law is, not it ought to be", and that's because "the science of law has been mixed with elements of psychology, sociology, ethics, and political theory, matters that are closely connected with the law." Chapter VIII is the best. If the law is to be applied by a legal organ, he must determine the meaning. In doing so, this is not (should not be) a free will exercise.
