The product is defective, the goods have been returned, and the merchant does not refund, is it cheating consumers?

If I could rate this product as' starless', I would. The ink cartridge is not working in my printer. Their 'warm reminder' is not helpful in solving this problem. It's a complete waste of money. I have been trying various excuses to appease me and refuse to refund when communicating with customer service.
