We have a flat drain...can I just sit this over it?? The drain itself is flat and leaves block it.

technically, yes. you’d likely want to secure it to the existing drain. the challenge will be that the drain will not be operational until the water level rises above the edges of this grate. perhaps you could drill holes in the sides to mitigate the issue. i had the same issue with a flat drain and this grate was the perfect solution, though i used the traditional installation method of replacing the existing flat grate with this one.
