The one I received just a few days ago was in the original, unopened box and was in fantastic condition.

I bought it for my 2 year old grandson. He loves it, I don't recall any loose parts. I think it will be safe for your three year old. Long as you taught him not to put objects in his mouth. Like I'm doing with my grandson. I hope that answers your question.
