What is Justice?: Justice, Law and Politics in the Mirror of Science

Only the greatest thinkers can write with complete clarity. The short list includes Hans Kelsen in law and Bertrand Russell in philosophy. I don't agree with Kelsen's separation of law and justice, but Kelsen was a skeptic of the highest calibre and his writings are important whether you agree with him or not.

"Let there be justice even if the world perishes!" This is the book that proves that it is impossible to implement a just system in this physical world. Hans Kelsen builds his logic in an eloquent and perceptible manners. This is a book that you'll read over and over again --not because it is difficult to understand, but because it is a great book.

２０世紀を代表する法学者の一人であるケルゼンの名著である。木鐸社から本書中のいくつかの論文が訳文で出版されているが、本書で第二次大戦で欧州出身でユダヤ系の出自ゆえに米国に亡命したケルゼンの「正義とは何か」全文を拝読出来る。純粋な理論の美しさ、厳しさ・・・しかし、その背後には、「正義」のもとに民衆を圧迫してきた為政者たち、そして科学の仮面をつけて自身の所説をまことしやかに述べ立てる御用学者等への痛烈なイデオロギー批判が存在する。米国におけるケルゼンの世評は、必ずしもはかばかしくなかった、と仄聞するが、大変平易な英語でケルゼンの著作を拝読すると、神から与えられた永遠の正義などの amorous な言葉がことごとく仮面剥奪され、その対象は聖書が説く正義にも仮借なく及んでおり、米国市民には受け入れられなかったのだろう、と感じる。ケルゼンの純粋な理論構成、イデオロギー批判の立場は、今後の歴史のうねりの中で毀誉褒貶を繰り返しながら、繰り返し参照され続けるであろうと思われる。第二次大戦前はナチに逐われ、戦後は法実証主義というレッテルを貼られて、時代の変遷の中で、左右の立場から批判されたケルゼンの現実は、図らずも本書においてその思想の屹立した一貫性を証言明している、と評し得よう。
